GDS Union Telangana Circle met Smt.Renukha Chowadary , Hon’ble Member of Parliament (Rajya Sabha )

Our NUGDS Khammam Division team met Smt.Renukha Chowadary , Hon’ble Member of Parliament (Rajya Sabha ) on 22.01.2018 and conveyed gratitude towards her intervention in the implementation process of GDS Pay Committee Report.

The Delegation also requested the Hon’ble MP to take initiative for amendment of the GDS Conduct & Engagement Rules, 2011 particularly Rule 3A(i)Rule 3 A (i) clearly mention no GDS perform their duties beyond 5 hours.

The delegation explained the RICT& IPPB structure and GDS are the only outlets for these Banking& Direct Benefits Schemes.
Hon’ble MP assured to take up this issue as a policy matter and will do needful to all GDS.

Subject: Selection to the post of Vigilance Commissioner in the Central Vigilance Commission.

The Government of India has constituted a body under the Central Vigilance Commission Act, 2003 (the Act) known as the Central Vigilance Commission (CVC) to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in New Delhi. The Commission consists of a Central Vigilance Commissioner and not more than two Vigilance Commissioners. The functions and powers of Central Vigilance Commission are as per chapter III of the Act.

2. It is proposed to appoint a Vigilance Commissioner vice Shri Rajiv, who is to demit office on completion of his tenure.

3. The Vigilance Commissioner shall hold office for a term of four years from the date on which he/she enters upon his/her office or till he/she attains the age of 65 years, whichever is earlier.

4. The Vigilance Commissioner, however, on ceasing to hold the office, shall be eligible for appointment as the Central Vigilance Commissioner, provided that the term of the Vigilance Commissioner, if appointed as the Central Vigilance Commissioner, shall not be more than four years in aggregate as the Vigilance Commissioner and the Central Vigilance Commissioner.

5. The salary and allowances payable to and other conditions of service of the Vigilance Commissioner shall be the same as those of a Member of the Union Public Service Commission subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act.

6. For complete information and details interested applicants should refer to the Central Vigilance Commission Act, 2003.

7. Eligibility and other requirements:

7.1 Section 3(3) of the CVC Act, 2003, provides that the Central Vigilance Commissioner and the Vigilance Commissioner shall be appointed from persons —
a) Who have been or are in All India Service or in any civil service of the Union or in a civil post under the Union having knowledge and experience in the matters relating to vigilance, policy making and administration including policy administration; or
b) Who have held office or are holding office in a corporation established by or under any Central Act or a Government company owned or controlled by the Central Government and persons who have expertise and experience in finance including insurance and banking, law, vigilance, and investigations;
provided that, from amongst the Central Vigilance Commissioner and Vigilance Commissioners, not more than two persons shall belong to the category of persons referred to either in clause (a) or clause (b)

7.2 In case of persons falling under section 3(3)(a) of the Act as above, such persons, preferably have held or is holding the post of a Secretary to the Government of India or any equivalent post thereto under the Central Government.

7.3 In case of persons falling under the first part of section 3(3)(b) of the Act as above, the person must have held or is holding the position of Chairman / Managing Director / Chief Executive Officer (CEO) of a Schedule ‘A’ Public Sector Enterprise and has served as a Whole Time Director on the Board for a period of at least 3 years.

7.4 In respect of persons who have expertise and experience in finance including insurance and banking, law, vigilance and investigations, and falling under the second part of section 3(3)(b) of the Act, such persons must have acquired eminence and have outstanding achievement in the said field(s) provided that such persons who are in employment in a private company must have held or is holding the position of Managing Director / CEO, as Whole Time Director on the Board of the Company for a period of at least three years.

7.5 All applicants should be of outstanding merit and impeccable integrity and should have knowledge and at least 25 years of experience in the relevant fields.

7.6 The applicants should not be more than 62 years of age as on 1st January, 2018 so that the persons to be considered for selection will get at least 3 years tenure as a Vigilance Commissioner.

8. Persons fulfilling the criteria for appointment as Vigilance Commissioner and interested in being considered for appointment to the post may send their application in the enclosed proforma to the Under Secretary (AVD-III), Department of Personnel and Training, North Block, New Delhi by 19th February, 2018.

9. Serving persons are required to send their applications through proper channel. They can send their applications as an advance copy directly to DoPT by the stipulated last date, but those applications will be considered only if they are finally received through proper channel.

10. The applications received after the due date will not be considered under any circumstances.

Subject : Memorandum on the policy decision taken by the Government against the interest of state owned Defence Industry and its Defence Civilian Employees.

Respected Madam,
Your kind attention is drawn to the joint representation submitted by the three recognized Federations of Defence Civilian Employees (AIDEF, INDWF and BPMS) dated 16.10.2017, 24.11.2017, 05.06.2017 and 14.12.2017. In all the representations the three recognized Federations have expressed their concern about the following policy decision taken by the Government.

“ that the decision taken by the Government to outsource and privatize Defence Production and related activities like Research, Maintenance and Services etc. and to permit 100% FDI is not in the interest of Defence Preparedness of our Country”.

“ that the hasty move of the Government to declare more than 200 Products being manufactured by the Ordnance Factories as “Non-Core” and to stop its production in the Ordnance Factories and to hand over the same to Private Corporates / Industries and to further increase the number of items as “Non-Core” is only to benefit the private Industrial houses at the cost of Ordnance Factories. The move of the Government will result in dismantling various Ordnance Factories established, surpused and developed over a period of more than 200 years in different disciplines and technology. This is nothing but a suicidal move, since once the Ordnance Factories are dismantled, the private players will dictate terms to the Government and the Armed Forces”. “that the decision of the Government to grant Uniform / Dress Allowance to the Soldiers (PBORs) @ Rs. 10,000/- per annum instead of Stitched Uniforms will result in the Soldiers purchasing substandard quality of Uniform Cloth from the Market which is not subjected to any quality of Uniform Cloth from the Market which is not subjected to any quality test as being done in the Ordnance Factories and manufacturing in different style which takes away the similarity in the shade, design, mismatch of the combination fo Trouser and Jacket which will look very awkward especially during the parade etc. Apart from this the decision will have a serious impact on the existence and future of 5 OEF Group of Factories and its 12000 Employees including 2000 Women Employees”.

“that the proposal of NITI Aayog for introducing PPP Model in the Small Arms Group of Factores, to allow Private Corporates in the Ordnance Factories in the name of “Joint Venture” etc. is nothing but handing over the national assets to the Private Corporates”.

“that by arbitarily directing OFB to stop working overtime on Sundays in lieu of Holidays has resulted in failure of targets for the year 2017-2018 upto Rs. 2500 crore and huge financial loss to the Employees of Ordnance Factories, since overtime wages have become a part of the monthly wages of the Employees.

“that the continuous dilution of the role of DRDO, handing over the permanent and perennial research and related developmental activities to private agencies and reducing the strength of permanent skilled and devoted workforce in the DRDO is an alarming situation. The DRDO is being forced to handover all new technologies developed by them to the Private Sector by ignoring the Ordnance Factories and Defence Public Sector”.

“that the so called reorganization proposal is nothing but to minimize the rate of DGQA with the ultimate intention of abolition of DGQA functions”.

“that the decision of the Government to close down Station Workshops, Military Farms and Depots etc. and to convert the Army Base Workshops to GO CO Model which means to handover the EME Workshops to the Private giants like L&T etc, is not in the interest of Defence Preparedness”.

“that the decision taken by Army HQ. to stop recruitment in the Army Units and to declare more than 3000 Army Civilian Employees as Surplus is in contradiction of the Government’s declared policy of employment generation and also against the policy of reservation in Government Jobs for socially and economically down trodden Communities, and physically challenged persons”.

“that the decision taken by the Government to declare more than 9000 Employees of the MES surplus, when there is an acute shortage of manpower in MES”.

It is unfortunate that the Ministry of Defence have not considered the representations of the Federations and the Unions of the Defence Civilian Employees on the above issues and due to which there is a total discontentment and dissatisfaction amongst the Employees since, their future is in total dark. The state owned Defence Industries including Ordnance Factories, DRDO, DGQA, MES, EME, Depots under ADC, Military Farms, DGAFMS, DGAQA, and other Army, Naval and Air Force Establishments under the Ministry of Defence may please be treated at par with the Armed Forces since all these Units are the forth force of the Defence of our Country and hence they deserve the status of “War Reserve” and should be strengthened, develped and expanded in the interest of National Security and Defence Preparedness.
Respected Madam, we are still of the hope that the MoD will consider all the above issues in its true spirit and come forward to review and reconsider all the above decisions and will have a negotiated settlement with the Employees representatives.

A meeting of the three recognized Federations (AIDEF, INDWF, BPMS) was held at Kolkata on 05.01.2018. The following were present

The meeting reviewed the Black Badge demonstration held on 28.12.2017 all over the country. The meeting congratulated all the affiliated Unions, the Unit level unions, Associations and all the Defence Civilian Employees who participated in the demonstration. Thereafter, the meeting expressed its concern about the unhelpful attitude of the Government in not responding to the representations of the Federations and to settle the demands put forth before the Government. Thereafter, the following decisions are taken unanimously.

1) The demonstration before the Parliament at Delhi on 15.02.2018 as decided will be held successfully by mobilizing the Defence Civilian Employees. For this purpose the representatives of the three Federations, at Delhi will make the logistic arrangements including getting Police permission and setting up of stage, Public address system etc.

2) Since, the 5 DEF Group of Factories, 8 ABWs, 14 Station Workshops, 39 Military Farms 4 Depots and MES are going to be affected immediately due to the policy decisions taken by the Govt. recently, it has been decided that a “One Day Call attention Strike” is required to be observed by the employee of these Units. Accordingly, the following time table is decided :-

a)21.02.2018: Strike Ballot by AIDEF Unions
b)22.02.2018: Strike Ballot by INDWF Unions
c)23.02.2018: Strike Ballot by BPMS Unions

Local Unions not affiliated to the three Federations in the action Committee may take the Strike Ballot as decide in the local action Committee at the Unit Level.

d) 28.02.2018: Issue of Strike Notice with Massive Demonstration.

e) 15.03.2018: “One Day Call attention Strike” by the Employees of 5 OEF Group of Factories, 8 ABWs, 14 Station Workshops, 39 Military Farms,, 4 Depots and MES.

3) All the Unions in all the other Defence Establishments will observe a solidarity action in support of the striking employees on 15.03.2018 by holding demonstration, gate meetings and rally etc.

4) After the Call Attention Strike on 15.03.2018 the three Federations will again meet and decide for a further serious action programme in all the Defence Establishments.

5) The campaigning programmes against the policy decisions of the Govt. in all the Defence Units may be continued and intensified by all the Unions.]

The three recognized Federation appeal to all the Unions, Associations and the Defence Civilian Employees to make the protest programme from 08.01.2018 to 12.01.2018 a grand success. The memorandum jointly to be submitted by all the Unions at Unit Level to the Defence Minister through Head of the Establishment on 12-01-2018 is also enclosed herewith.

Sub:- Pending demands of my federation – Reg
Ref:- 08-12/2017-SR dated 01/08/2017.

Your attention is invited to the letter cited, wherein our Department has given a reply to my federation on each demand and requested us to withdraw the agitation programme of the strike. My Federation secretariat has taken the decision to postpone the strike. To our dismay, most of the demands are still in the same position for the last 7 months and in some issues, there is some development. But no issue is settled as on date.

The list of Demands and the reply from your office on each item is enclosed for your reference.

Further, some of the issues which are already pending with DOP&T the other ministries have taken steps in favour of their employees hence my federation requests the chairman to take appropriate action on the following subjects.

  • Granting the benefits of MACPs w.e.f. 01/01/2006 as per 6th CPC based on the judgement of the Honourable Supreme Court.
  • Restore OTA, OSA & Special allowance of PO & RMS Accountants.
  • One-time relaxation to the Central Government employees who have availed LTC-80 and travelled by air, by purchasing tickets from authorities other than authorised agents.
  • Removal of ambiguity in fixation of pay of re-employed ex-servicemen and grant of the benefit extended to commissioned officers to personnel below officer tank also.
  • My Federation strongly believes that the Chairman, Postal Board will take necessary action on our letter.

Filling up of all vacant posts
in all cadres of Department of Posts i.e. PA, SA, Postmen, Mailguard, Mailmen, Drivers,  and Artisans in MMS, MTS, PACO and GDS.
GDS: Process of online engagement of GDS has already been started to fill up vacant post of GDS in 17 Circles. Due to technical snags in the online engagement software, process in remaining Circles will be started only after process in 17 Circles will finalize.
PA/SA: Result of PA/SA for the year 2015 is kept in abeyance as the matter is subjudice. Vacancies of PA/SA for the year 2016 have already been intimated to SSC.
LGO exam for promotion to the cadre of PA/SA for deputation to APS has been conducted on 04.06.2017.
LGOs exam for promotion to Assistants in MMS, Foreign Post, RLO, Stores Depot and CO/RO has been held on
16.07.2017.
In r/o other exams, viz. IP Exam 2016-17, PM Grade I and PS Group B 2017-18, LGOs to PAs/SAs 2016-17 and 2017-18, engagement of new approved Agency is in the pipeline. MoU between
Department and Agency is to be signed.
For the Postman/Mail Guard and MTS cadre exams, instructions have been issued to all the Circles to fill up the vacancies by giving top priority.
Calendar of departmental Examinations scheduled to be held in the year 2017-18 has already been issued to all the Circles by giving tentative schedule for filling up the vacancies of decentralized examination i.e. PO & RMS Accountant Examination, LDCs to Junior Accountants in PAOs (Exam has been conducted by respective Circles), LGOs examination for promotion to Assistants of other wings i.e. MMS, Foreign Post, RLO, Stores Depot and CO/RO and other exams.

Implementation of positive
recommendations of GDS Committee Report. Grant of civil servant status to GDS. Request to ‘Removal of 3-A (I) of GDS Conduct & Engagement Rules, 2011, Grant pension to all GDS without absorption as regular Group D – As per Principle CAT, New Delhi Judgement, Request to count service to all erstwhile GDS service to who have been absorbed as Group D/Postman – As per Principle
CAT, New Delhi Judgement.
The recommendations of the Kamlesh Chandra Committee have been considered by the Department of Posts and mandatory approval is being obtained in this regard. As far as grant of civil servant status to GDS is concerned, it is stated that according to Rule 3-A (v) of GDS Conduct Rules 2011, a Sevak shall be outside the Civil Service of the Union. Hon’ble Supreme Court of India in the matter of Superintendent of Post Offices Vs PK Rajamma (1977) (3) SCC held that the Extra Departmental Agents {now called Gramin Dak Sevaks} are holders of the civil post outside the regular civil services. Moreover, they are part time employees being engaged for maximum of 5 hrs a day. In the light of above legal position demand of the union cannot be acceded to.

Request to grant of a new scale
to the temporary status MTS on par with 7th CPC. Conversion of temporary status casual labourers into permanent as per the Directorate letter No. 25-07/2017-PE-I dated 16.05.2017.
In pursuance of the instructions issued by the Department of Expenditure, vide its O.M. No. A-11012/11-EG dated 19.12.2016, all the HoCs have been instructed, vide this office letter dated 16.05.2017, to convert the temporary posts into permanent ones up to the level of Dy. Secretary (i.e. having Grade Pay of Rs. 7600/- or less in the pre-revised scale excluding GDS posts), subject to the condition that these posts have functional justification and are in existence for more than
three years. Thus, Casual labourers don’t come under the purview of this order.
4.
Stop all types of harassment and victimization in the name of new schemes and technology induction and under contributory negligence factor and Trade Union victimization.
FS Division has informed that no new schemes are launched by that Division on behalf of DoP. The DoP is operating Small Savings Schemes on behalf of MoF. PLI Directorate has informed that they have completed roll out of Core Insurance Solution (CIS) as on 25.01.2016 to 808 HOs and 24598 Sub Post Offices as per the information provided by Circles. Roll out of RICT has not been initiated so far. They have also informed that at no point of time any case of harassment & victimization of staff has come to their notice.
5.
Payment of revised wages and arrears to the casual, part-time, contingent employees and daily rated mazdoors as per 6th & 7thCPC and settle the other issues of casual labourers.
The orders in respect of minimum pay for calculation of pay of casual labourers (without temporary status) has already been issued vide this office letter no. 7-10/2016-PCC dated 31.03.2017.

Implement cadre restructuring for left out categories i.e. RMS, MMS, PACO, Postmaster Cadre Postal Civil wing etc. and accept the modifications suggested by NAPE-C before
implementation of cadre restructuring in Postal Group ‘C’ & demands of National Union of Postal Civil Wing Employees.
The cadre restructuring of left out cadres, i.e. RMS, PACO and PASBCO is currently under examination in consultation with the Department of Expenditure. The matter of cadre restructuring of Postmaster Cadre will be examined thereafter.
A Committee has been constituted, vide this office letter no. 25-04/2012-PE-I dated 09.06.2017, under the chairmanship of Shri Charles Lobo, CPMG Karnataka Circle, to examine the
issues arising out of implementation of Cadre Restructuring of Group C employees.
Cadre review of MMS is under
active consultation with Ministry of Finance, DoE.

Provision of CGHS facilities to Postal Pensioners also as recommended by 7th CPC.
The CGHS facilities have been extended to the pensioners of Post and Telegraph Department by the M/o Health & Family Welfare vide O.M. No. S-11016/2/2015-CGHS(P)/EHS dated
19.07.2017 and the same has been circulated by the Dte. To all the Circles vide letter no. 2-3/2009-Medical dated 25.07.2017.
The issue of merger of 33 Postal Dispensaries is under consideration with the Ministry of Health & Family Welfare.

Withdraw NPS (Contributory Pension Scheme). Guarantee 50% of last pay drawn as minimum pension.
The demand for withdrawal of NPS (Contributory Pension Scheme) is outside the purview of this Department. As regards guarantee of 50% last pay drawn as minimum pension, it is mentioned that govt. has already enhanced minimum pension to Rs. 9000/- w.e.f. 01.01.2016. The pension of retiring employees is fixed at 50% of emoluments or average emoluments, whichever is more beneficial under Rule 49(2) of CCS (Pension) Rules. Government has also decided to revise pension of pre-2016 pensioners to 50% of notional pay in pay matrix of 7th CPC by fixing pay on notional basis during each intervening Pay Commission.

Implement five days week working for operative staff in the Postal Department.
Since the Department of Posts is a service oriented Department, decision of 5 days week lead to public inconvenience and further, to public complaints. This decision will also results in revenue loss to the Department as customer will go for other alternatives when Post Offices are closed on Saturday.

Stop Privatization, Contractorization and outsourcing.
There is no proposal of corporatization/privatization at this juncture.  The Department is making efforts to give better and competitive services to the customers specifically in the areas of insurance, banking and parcels

Sub: Guidelines on “CGHS benefits to Central Govt. employees (serving/retired) covered under New Pension Scheme”-reg

The undersigned is directed to say that the matter regarding extension of CGHS facilities to Central Govt. employees (serving/retired) covered under New Pension Scheme (NPS) was under examination in this Ministry.

2. The matter has been examined in this Ministry in consultation with Department of Expenditure and Department of Pension & Pensioner’s Welfare and the guidelines for NPS subscribers to be eligible for CG HS facilities are as follows:

(a) Minimum years of qualifying service for eligibility of CGHS membership after retirement- 10 years.

(b) No minimum qualifying years Of service for availing CGHS facilities in case of death/disability.

(c) In case of absorption into AB/SB’s, NPS subscribers can avail CGHS after their retirement only if the SB/AB where they were absorbed is covered for their retired employees, subject to condition (a) above.

(d) In case of deputation to AB/SB’s, no CGHS coverage till such period of deputation continues unless the entity to where the employee has been transferred is covered by CGHS.

(e) Status-quo to be maintained for‘serving NPS subscribers subject to conditions at (c) and (d) above.

(f) Other conditions such as definition of family, CGHS contributions, conditions of dependency etc will be applicable as per existing rules.

3. This issues with the approval of the Competent Authority.
