Revision of Minimum Rates of Wages

The Central Government in exercise of the powers conferred under clause (b) of section 3 read with clause (i) of Sub-section (1) of Section 4 of the Minimum wage Act, 1948 has revised the minimum rates of wages per day for all category of employees specified in column No.(1) of the Gazette Notification S.O.No.186(E) for the schedule Employment of Agriculture which is effective from the date of publication i.e. 19th January, 2017. The revised rates of minimum wages per day is given below.

Meeting Of the COC Karnataka was held on 6th April 2017

Comrades,

The well attended meeting of the COC Karnataka was held on 6th April 2017 at ITEF Room Bangalore under the chairmanship of Com S. Radhakrishna President COC Karnataka.

Com Radhakrishna welcomed the members for the meeting , he congratulated the members for the historic 16th March strike of CG employees , it is against the policy of the Central Government which is anti-employees, the issues of NPS , Pension , Allowances , Fitment formula and Minimum wage revision has not been resolved so far. He also said the policy of outsourcing the Government jobs should be stopped and filling up of vacant post are to be taken up on priority basis. He also informed that large section of pensioners participated in the rally held on Freedom Park on 16thMarch 2017. This is a good sign.

Com P.S.Prasad General Secretary he welcomed the members for the meeting , he congratulated the members for the historic 16th March strike of CG employees, this strike is proved the anger of CG employees in non-fulfilment of promises made by Group of Ministers regarding Fitment formula enhancement and Minimum wage revision, settlement of Allowances, NPS and Pension issues.

Com Prasad Informed that majority of the affiliates of the COC Karnataka participated in the strike , but a few employees has not participated in the strike. A through analysis is to be carried out. The media has given good coverage in both Bangalore and at districts such as Udupi , Mangalore , Hubli , Mysore , Sirsi, Shimoga etc.

Regarding allowances it was pointed out every member is demanding its early implementation, it will be brought to the notice of the CHQ and the meeting hoped the issue of allowances shall be resolved shortly.
The meeting discussed the 9th State Level Conference of the Confederation of Central Government Employees and Workers Karnataka State issue.

The following decisions taken place.

1) It was decided to hold the 9th State Level Conference of the Confederation of Central Government Employees and Workers Karnataka State at Income tax office on 1st June 2017 .

2) The delegate fee is Rs 200/ per member , it was decided in invite about 150 delegates.

3) The 9th State Level Conference will be addressed by both the Secretary General and President of Confederation.

4) Regarding district representation for the conference , two delegates from each districts shall participate in the conference, the accommodation for one day shall be provided .

5) The accommodation for out station delegates shall be provided at the cost of Rs 150 per delegate for one day.

6) The total cost of Rs 70,000/ is anticipated for the conference , additional funds to be collected from the affiliates, Com Mohan Pai from Census has assured an amount of Rs 10,000/ and ITEF will provide an amount of Rs 5,000/. Each affiliate of COC Karnataka shall pay special funds @ Rs 5 / per member .

7) The election of office bearers shall be held on the basis of nomination from the respective affiliates, only the post of General Secretary , President shall be decided in the conference with due consultation with affiliates. The women subcommittee shall be formed , each affiliates shall also nominate women committee members.

8) The affiliates of COC Karnataka shall clear the subscription dues for the year 2016-17 by this month.

9) The draft GS report and Accounts was circulated any modifications and additional information especially on department issues should be supplied for incorporation in the report.

10) The meeting also decided to send the delegates for attending the trade union classes to be held at Thiruvananthapuram in May 2017 .

The Com A.Srinivas Postal JCA convenor spoke and he informed that the strike of 16th March was a success , but more efforts should be made to make this strike a success . The weakness of the affiliates should also be highlighted, so that corrective measurers can be taken. He also said importance on filling of vacant post should be taken up and stopping of privatisation of Government work.

Com Janikiram wanted co-operation from the COC Karnataka in conducting 31st All India Conference of All India Postal Employees Union Group “C” to be held in Bangalore from 6th August 2017 to 9thAugust 2017. The COC Karnataka shall provide all types of co-operation.

Meeting ended with vote of thanks.

The next meeting of COC Karnataka shall be held on 17th May 2017.

Shri Rajnath Singh inaugurates Web Portal “Bharat ke Veer”

Portal enables people to contribute towards family of martyrs

The Union Home Minister, Shri Rajnath Singh inaugurated the web portal and mobile application named “Bharat ke Veer” on the occasion of Valour Day of Central Reserve Police Force (CRPF) here today. The portal is an IT based platform, with an objective to enable willing donors to contribute towards the family of a braveheart who sacrificed his/her life in line of duty. The amount so donated will be credited to the account of ‘Next of Kin’ of those Central Armed Police Force/Central Para Military Force soldiers. The actor Shri Akshay Kumar was the Guest of Honour during the function.

Speaking on the occasion, Shri Rajnath Singh said that he pays heartfelt tribute to the soldiers who sacrificed their lives for the safety of nation. He said that each moment of lives of CRPF and CAPF personnel is a test of their courage and bravery. He said that a bullet can hit a soldier physically, but no bullet can defeat the courage and motivation of a soldier. The bravery of CRPF commandant, Chetan Cheetah is an example of it who survived 9 bullets, Shri Rajanth Singh added.

The Union Home Minister thanked the actor Shri Akshay Kumar for contributing his ideas to the launch of Web Portal “Bharat ke Veer”. He said that he is satisfied that this portal will be successful and will act as a motivation to the brave soldiers. He said that Shri Akshay Kumar is a hero for people, but Shri Akshay Kumar’s real heros are the soldiers of Paramilitary Forces. Shri Rajnath Singh appealed to the nation to visit the web portal and contribute maximum towards the corpus. The Union Home Minister said that CRPF has a multi-dimensional role to play and he is proud of their bravery and valour. He also said that the martyr’s family should get a support of minimum Rs one crore and the Government would meet the gaps, if any. He said that 45-50% decline in the LWE incidents, 75% decline in incidents in North-East and decline in terror-incidents in Jammu and Kashmir during the last three years is the contribution of the Forces.

The Secretary (Home), Shri Rajiv Mehrishi also thanked actor Shri Akshay Kumar for conceptualizing the idea of this portal and making his contribution to the martyrs’ families.

Speaking on the occasion, actor Shri Akshay Kumar said that this web portal has been designed in a record time of just two and a half months. He said that it will act as a support to the families of the soldiers who sacrificed their lives for the nation. He said that this will act as a platform for those who want to contribute to the families of the bravehearts, but are not aware of the channel. He thanked the Ministry of Home Affairs for working towards launching this portal

The site “Bharat ke Veer” will be available on web portal as well as mobile application. This domain allows anyone to financially support the bravehearts of his choice or towards the “Bharat Ke Veer” corpus. This website is technically supported by National Informatics Centre (NIC) and powered by State Bank of India. To ensure maximum coverage, a cap of 15 lakh rupees is imposed and the donors would be alerted if the amount exceeds, so that they can choose to divert part of the donation to another braveheart account or to the “Bharat Ke Veer” corpus. “Bharat Ke Veer” corpus would be managed by a committee made up of eminent persons of repute and senior Government officials, who would decide to disburse the fund equitably to the braveheart’s family on need basis.

On the occasion, the Home Minister awarded Police Medal for Gallantry to the CRPF personnel (including posthumously) on the occasion of Valour Day today. The Valour Day is celebrated in remembrance of an act of unparalleled bravery displayed by a small contingent of CRPF personnel, pitted against a full-fledged infantry brigade of Pakistani Army, trying to overrun their post, at Sardar Post, Rann of Kutch, Gujarat on April 09, 1965. They not only defeated the Pakistani brigade but also killed 34 Pakistani soldiers and captured 4 of them alive. The CRPF successfully defended the post till the arrival of reinforcements. The saga of valour of Sardar Post is a rich source of inspiration to the officers and men of CRPF and befittingly 9th April is observed as the “Valour Day”.

Shri Parameswaran Iyer, Secretary, Drinking Water and Sanitation, Shri Sudeep Lakhtakia, DG (Off.), CRPF, Shri Rajiv Jain, Director, IB, DGs of CAPFs and other senior officers were also present on the occasion.

Sub: Non-Payment of Over Time Allowance to the staff working on Track Machines on south East Central Railway-Reg.

Ref: (i) CPO,SEC Rly’s letter No.P-HQ/RUL/118/2/6234 dated 24/25-02-2015 & P-HQ/RUL/118/2/767 dated  15-05-2015.
(ii) Railway Board’s Letter No.E(LL)/98/HER/9 dated 09-04-2015.
(iii) NFIR’s letter No.I/8/Part I dated 06/06/2016
(iv) Railway Board’s letter No.98/E(LL)/HER/9 dated 24/03/2017.

Federation is disappointed to note the contents of Railway Board’s letter dated 24-03-2017 wherein Board has clarified to the GM (P)/S.E.C. Railway that the principle of averaging for payment of OT Allowance to the Track Machine Staff to be given effect from 10-07-2013, the date of issuance of Board’s letter. Federation is constrained to state that the Board has completely ignored the rule position contained in letter dated 06-07-2000, 10-07-2016 and issued wrong clarification,Federation also feels sad to convey that mere copy has been endorsed to NFIR, without mentioning NFIR’s reference to Railway Board.

So far as clarification issued by Board is concerned, the Federation does not agree with the same in the light of the following facts/merits.

i) The Railway Board vide letter No.E(LL)98-HER/9 dated 06-07-2000 had introduced duty roster in respect of Staff working on Track Machines and laid down rostered hours of work for three weeks at a stretch followed by rest for a continuous period of one week at the Headquarters in consultation with the Ministry of Labour. These instructions further stipulated that the individuals shall not be employed for more than 12 hours on any day and in respect of Overtime payment, the staff will be governed by the extant instructions under HOER i.e. principle of averaging.

ii) subsequently Railway Board vide letters dated 09-09-2009 & 30-10-2012 had conveyed continuance of three weeks roster at a stretch followed by continuous rest of one week at the Headquarters (valid upto September,2015).

iii) On raising the issue relating to non-payment of Overtime to the Track Machine Staff working on Zones by the NFIR at Board’s level, Railway Board vide letter dated 10-07-2013 had again issued instructions that the Track machine Staff when deployed for 3 Weeks continuously followed by one week rest, the payment of overtime be regulated by the principle of averaging on four weekly basis whenever hours exceed 192 hours and keeping in view the provisions of Board’s letter dated 11-06-1974.

iv) Railway Board vide letter dated 16-06-2016 has again reiterated for implementation of instructions envisaged in Board’s letter dated 6-7-2000.

v) It needs to be appreciated that Board’s instructions dated 06-07-2000 have neither been modified nor superseded. Therefore, Payment of Overtime to the Staff working on Track Machines is required to be regulated in terms of Board’s instructions dated 06-07-2000 from that date and not from the date of issue of Board’s letter dated 10-07-2013.

The facts mentioned above clearly establish the entitlement of overtime payment with effect from 06-07-2000 and not prospectively. Accordingly, the Track Machine Staff of south East Central Railway who have been denied Overtime payment from August 2010 by the zonal Railway due to mis-interpretation of Rules are rightly entitled from August, 2010.

NFIR, therefore, requests the Railway Board to review its clarification dated 24-03-2017 and issue fresh clarification to the Zonal Railways in general and south East Central Railway in particular for implementing instructions dated 06-07-2000 and allowing overtime payment retrospectively. A copy of the instructions issued may be endorsed to the Federation.

As requested by the Federation vide their letter dt. 22.09.16 to examine the matter in context of their letter No.lV/MACPS/09/Part 10, dt. 09.05.2016. Accordingly, the matter has been examined and replied to NFIR vide Board’s letter dt. 21 .10.2016. Further, DoP&T has already been consulted on the issue and they have not agreed to the proposal saying that the services should be reckoned from the date of direct recruitment as mentioned in the policy circular issued in this regard. As no other course of action appears to be left available, the item may be ‘closed’.

As requested by the Federation, the matter has been reviewed based on the information obtained from Central Railway as well as in light of the extant instructions on the subject and accordingly. Denial of financial upgradation under MACP Scheme to the serving Graduate Clerks inducted againist LDCE Quota on East Coast Railway.
As decided in the meeting held on 19th  & 20th  May, 2016, E.Co.Railway have been asked to advise the rule and methodology under which the pay of the employees promoted as Sr. Clerks through LDCE against 13 1/3 % quota has been fixed. Reply from E.Co.Railway isawaited. Further, as per para 2 of Board’s letter dt. 18.06.81 and also in terms of Board’s letter dt. 07.10.97 benefit of pay fixation has been allowed on promotion to Sr. Clerks post through LDCE. Therefore, this promotion has to be counted for the purpose of MACPS.

The factual position/details about the cadres where ACP Scheme is more advantageous than MACPS as contended by the Federations have ascertained from Railways. The same is under examination.

MACP benefits to railway employees- Cases of employees joining another unit/organization on request. (Railway Board’s Letter No. PC-V/2009/ACP/2 dt. 31/01/2013 NFIR’s letter dt 29/07/2013).
As desired by the Staff Side, necessary instructions have been issued vide Board’s letter dt.23.11.2015 (RBE No.147/2015) and thereafter a corrigendum has also been issued vide Board’s letter dt.17.02.2016 (RBE No. 19/2016).

Provision of all benefits on financial upgradation under MACPS-including entitlements for travel & treatment in hospital etc.
In the meeting Staff Side was requested to come out with specific entitlement which are being denied to such Staff. No reply from the Staff Side has been received so far.

Wrong implementation of MACP Scheme in IT Cadre/Granting of financial benefit under MACP Scheme to EDP Staff.

Sub: Grant of Children Education Allowance to mentally disabled to two children in case of first child beins totally mentally disabled – reg.

Ref: Railway Board’s letter No.E(W)2014/ED-2/4 dated 24/09/2014 and E(W)2008/ED-2/4 dated 0/06/2015.

Federation has been receiving grievances from those Railway employees who unfortunately have been graced with 1st child (out of three living children) being mentally disabled/retarded and is unable to receive education even at a school meant for the differently abled children due to physical/mental infirmity. Federation feels disappointed to note that the extant instructions contained in Board’s letter dated 24/09/2014 & O1/06/2015, cited under reference, do not cover the genuine problems faced by the Railway employees, consequently, payment of Children Education Allowance to the third ward is denied on the plea that the CEA/Hostel subsidy shall be admissible only to the eldest two surviving children.

Federation also feels that the genuineness of these types of cases has not been brought to the notice of Government (DoP&T, MoF), for consideration. Federation feels that the condition for reimbursement of Children Education Allowance/Hostel subsidy imposed by the DoP&T needs to be reviewed and relaxed suitably so that any two children out of three can become eligible for CEA and Hostel subsidy in those cases where one of three being differently abled and cannot receive education under any circumstances.

NFIR, therefore, requests the Railway Board to kindly make out proper case with justification and refer the matter to the DoP&T for granting relaxation of the condition so that payment of Children Education Allowance/Hostel subsidy is ensured to two school/college going children out of three – one of whom being totally disabled. A copy of the proposal sent to the DoP&T may kindly be provided to the Federation for taking up the issue at Government’s level.
