Sub:-Board’s item No.3-Grant of financial upgradation under MACP Scheme in the promotional hierarchy-(instead of Grade Pay hierarchy)- as per judgment of various courts. {item(s) to be discussed with Board (MS &FC)}

Ref:-NFIR’s letter No.lV/MACPS/09/Part 10, dated 20.02.2017.

The undersigned is directed to refer to item No.3 of the record note of discussions held on 12.10.2015 on MACPS anomalies whereby NFIR have stated that ACP Scheme is more advantageous than MACPS for certain catggories of employees viz. office Clerks/Accounts Clerks, Commercial Clerks, Stenographers, Technician Gr.lll and Shroff category.

In this regard, the factual position prevailing on Railways has been ascertained from a Railway i.e. Northern Railway in respect of these categories of employees and on a perusal of the same, it has been observed as under:-

The employees directly recruited as Office Clerk (GP Rs.1900) are getting Grade Pay of Rs. 4600 as 3rd MACPS whereas under ACP Scheme no further financial upgradation beyond GP of Rs. 4200/- would be admissible.

The employees directly recruited as Technician Gr.lll (GP Rs.1900) are getting Grade Pay of Rs. 4200 as 3rd MACPS whereas under ACP Scheme no further financial upgradation beyond GP of Rs. 2800/- would be admissible.

The employees directly recruited as Shroff category (GP Rs.1900) after their promotion as Hd. Shroff in GP Rs.4200 have further been granted 3rd MACPS in Grade Pay of Rs. 4200 (as next promotional cadre post of ADC is also in the same Grade Pay of Rs.4200/-) whereas under ACP Scheme there is no provision for grant of 3rd financial upgradation.

The employees directly recruited as Stenographer (GP Rs.2400) are getting Grade Pay of Rs. 4800/- as 3rd MACPS whereas under ACP Scheme no further financial upgradation beyond GP of Rs. 4600/- would be admissible.

The employees directly recruited as Accounts Clerk (GP Rs.1900) are getting Grade Pay of Rs. 4600 as 3rd MACPS whereas under ACP Scheme no further financial upgradation beyond GP of Rs. 4200/- would be admissible.

Federations are requested to appreciate the factual position as mentioned above.

From the above, it can be seen that MACP Scheme is more advantageous than the ACP Scheme for the aforesaid categories.

Sub: Initial Pay Fixation of re-employed ex-servicemen who held post below Commissioned Officer rank in Defence Forces, retired before attaining the age of 55 years and have been appointed on re-employment basis in civilian posts - regarding.

The undersigned is directed to refer to NFIR's letter No.II/35/Part XIII dated 23.11.2016 on the above subject and to state that with the reference to Board's letter of even number dated 7-12-2016 addressed to DOP&T pursuant to the discussion in the separate meeting on the issue held on 27-09-2016, DOP&T vide their OM No.1213833/2016-Estt(Pay-II) dated 21/2/2017 (copy enclosed) have clarified that the pay of non-commissioned ex-servicemen (PBOR) who retire from the Defence Forces before attaining the age of 55 years is to be fixed as per the entry pay in the revised pay structure of the re-employed post applicable in the Direct Recruits appointed on or after 1.1.2006 without any protection of last pay drawn, in accordance with prevailing guidelines vide para 4 of OM dated 31.07.1986 as amended vide OM dated 05.04.2010 which provide for methodology of pay fixation on re-employment.

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether it is a fact that All India Nursing Federation has been demanding for revision of their pay scales and a hike in allowances, if so, the details thereof;

(b) whether Government has taken any decision on their demands; and

(c) the steps being taken by Government to appease the unions of nurses and persuade them to call off their strike?

(a) & (b): Yes. Like other Federations/Union, All India Nursing Federation (AIGNF) is demanding better pay and allowances to the Nursing Personnel. Their demands on various allowances such as Nursing allowance, Uniform & Washing allowance, Special Area Allowance etc. payable to Nurses and inclusion in the risk matrix as allowed by 7th CPC to various categories of Government servants has been referred to the Committee on Allowances comprising Finance Secretary & Secretary( Expenditure) as Chairman and Secretaries of Home Affairs, Defence, Health & Family Welfare, Personnel & Training, Posts and Chairman, Railway Board as Members. 

(c): Consultations/persuasion always made with the representatives of the Union/Federation to avoid strike.

(a) whether the Government has taken any measures to ensure timely disbursement of pension and retirement benefits to the retiring Government officials;

(b) if so, the details thereof;

(c) whether the Government has launched an online pension sanction and payment tracking system, “Bhavishya” for timely disbursement of retirement benefits; and

(d) if so, the details thereof ?

(a) to (d): In the recent past the Government has simplified pension rules relating to sanction of pension etc. which has since been incorporated in an online system for tracking of pension sanction and payment process called ‘BHAVISHYA’ for retiring Central Government Civil employees. Tracking can be done by the individual as well as the administrative authorities for all actions preparatory to grant of pension and other retirement benefits. Facility also exists for tracking payment of subsequent monthly pension. This is in line with the priorities of Government to ensure transparency and accountability in systems and processes.

(a) Whether the government has cleared the revised pension benefits as recommended by the 7th Pay Commission;

(c) whether the maximum gratuity and death gratuity will be Rs.20 Lakh and the ceiling on gratuity will increase by 25 per cent whenever the dearness Allowance rises by 50 per cent of the basic pay: and

(a) & (b): An OM No.38/37/2016-P&PW(A) (i) dated 4th August, 2016 has been issued by Department of Pension & Pensioners’ Welfare for revision of pension of Central Government Civil Employees retiring on or after 1.1.2016 and OM No.38/37/2016-P&PW(A) (ii) dated 4th August, 2016 has been issued for revision of pension of Central Government Civil Pre-2016 Pensioners/family pensioners in implementation of the 7th Central Pay Commission.



Ministry of Defence (Department of Ex-Servicemen Welfare) have issued a Resolution No.17(1)/2014/D (Pension/Policy) dated 30.9.2016 regarding decisions of the Government on Implementation of the recommendations of the 7th Central Pay commission. A letter No.17(01)/2016-D(Pen/Pol) dated 29.10.2016 has been issued by Ministry of Defence (Department of Ex-Servicemen Welfare) for revision of pension of pre-2016 Defence pensioners/family pensioners.

(c) & (d): As per OM No.38/37/2016-P&PW(A)(i) dated 4th August, 2016 Maximum limit of retirement gratuity and death gratuity has been increased from Rs.10.00 lakh to Rs.20,00 lakh w.e.f 1.1.2016. the ceiling of gratuity will increase by 25% whenever the dearness Allowance rises by 50% of the basic pay.

Demanding Honouring of assurance given by Group of Ministers including Finance Minister, settle the charter of demands submitted by Confederation, increase minimum pay and fitment formula, payment of revised allowances including HRA w.e.f 01.01.2016, implementation of option – I pension parity recommended by 7th CPC, Scrap New Contributory Pension Scheme and bring all employees appointed after 01.01.2004 under the purview of CCS (Pension) Rules 1972, Grant Civil Servant Status and revise the wages and allowances of Gramin Dak Sevaks, regularise all casual and contract workers, Revise pension of autonomous body pensioners and grant dearness relief due from 01.07.2016, withdraw “Very good” bench mark condition for MACP etc.

LTC Travel by Air India

As per instant instructions, the Leave Travel Concession (LTC) is applicable for travel by Air India and in Economy class only. However, relaxation has been given to travel by private airlines to visit Jammu & Kashmir with certain conditions.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office, Dr. Jitendra Singh in a written reply to question by Shri Sharad Tripathi in the Lok Sabha today.

Equal Pay for Equal Work in CPSUs

As per information received from Department of Personnel & Training (DoPT), the instructions regarding equal pay admissible to casual workers already exists in terms of DoPT O.M. No. 49014/2/86 Estt. (c) dated 07.06.1988. Further, Central Public Sector Enterprises (CPSEs) are under the administrative control of their respective Ministries / Departments and CPSEs are required to follow the various statutory provisions / Court orders / Government instructions including instructions on wage related issues of various categories of employees, wherever applicable.

However, as the responsibility to monitor the implementation of above said statutory provisions / court orders / Government instructions vests with the Board of CPSEs and the concerned administrative Ministry / Department, as such no centralized information in this regard is maintained by Department of Public Enterprises (DPE) and accordingly complaints, if any, received against any CPSE on this issue are also forwarded to the concerned administrative Ministry / Department of CPSE for appropriate action.

This information was given by Minister of State in the Ministry of Heavy Industries and Public Enterprises Shri Babul Supriyo in reply to a written question in the Rajya Sabha today.

Cabinet approves listing of 11 CPSEs on stock exchanges

The Cabinet Committee on Economic Affairs, chaired by the Prime Minister Shri Narendra Modi has given its approval for listing of the following 11 CPSEs (Central Public Sector Enterprises) on stock exchanges:

As approved, listing of CPSEs will be through public offer of shares upto 25 per cent of Government of India’s shareholding, which may include offer of fresh shares for raising of resources from market. However, actual disinvestment in respect of each CPSE alongwith the mode of raising resources has been delegated for decision on a case to case basis to the Alternative Mechanism, headed by the Hon’ble Finance Minister.

The CCEA has also approved reservation of shares for the eligible employees of 11 CPSEs in accordance with the extant provisions of SEBI Regulations.

With a view to ensure wider participation by small investors in the CPSEs’ disinvestment program, a price discount upto 5 per cent on the issue price has also been approved for the retail investors and eligible employees of 11 CPSEs participating in this offer.
From the economic and sectoral perspective, the decision to list 11 CPSEs on stock exchanges through public offer will have the following advantages for to the stakeholders:

i. Post-listing, value of a CPSE has the potential to be unlocked in multiples of book value of its equity with respective increase in their market capitalization. Once the book value of 11 CPSEs is discovered through the listing process, it will facilitate raising of resources by these companies at comparable cost and hence, achieve higher growth through their expansion/diversification. This will also be reflected in the performance at the sectoral level and overall economic growth.

ii. Listing of CPSEs will also promote ‘people’s ownership’ by encouraging public participation in CPSEs. Reservation of shares not exceeding 5 per cent of the post-issue capital for the eligible employees of 11 CPSEs, with the further decision to allocate shares to retail investors and employees of CPSEs at a price discount will ensure wider participation of small investors in the CPSEs’ disinvestment program.

iii. Listing of profitable CPSEs on the stock exchanges also triggers multilayered oversight mechanism, which not only enhances shareholders’ value but also promotes corporate governance norms in such companies. As per the listing requirements of SEBI/ Company Law/Stock Exchanges, CPSEs are required to comply with a number of mandatory disclosure requirements.

iv. With general public becoming the shareholder in the company through the listing route, the management is open to public scrutiny and thus become more accountable to its shareholders, as per the extant disclosure norms and compliance for listed CPSEs.

Background:

The Government has made the following announcement in Budget 2017-18:
“Listing of Public Sector enterprises will foster public accountability and unlock the true value of these companies. The Government will put in place a revised mechanism and procedure to ensure time-bound listing of identified CPSEs on stock exchanges…………..”
