OFFICE MEMORANDUM

Subject: Reimbursement in respect of Newspapers purchased/supplied to officers at their residence-guidelines regarding.

Department of Expenditure, Ministry of Finance, vide order no.1 (24)/E.IIA/96 dated 13th September, 1996, had issued guidelines on the subject cited above It has been felt that these guidelines are dated and need to be updated. It has therefore, been decided that in place of the existing practice of getting monthly reimbursement of newspaper on production of newspaper bills, reimbursement for newspaper may be made at the rates mentioned below based on the certification given by the entitled officer:

2. A certificate as per the Annexure, to the effect that expenditure has been incurred on newspaper shall be provided by the officers on half yearly basis to the office for reimbursement.

3. This issues in supersession to all earlier guidelines Of Department of Expenditure on the subject. The orders will be effective with immediate effect.

(a) whether it is a fact that Director General (Personnel) has been defying the order of President, regarding implementation of first cadre review of Barrack and Store (B&S) Cadre of Military Engineer Services (MES) for past three months;
(b) if so, the details of administrative action taken thereof;
(c) if not, the reasons therefor;
(d) whether it is also a fact that direct recruitment of officers of B&S cadre has not been done during last eight years;
(e) if so, the reasons therefor; and
(f) the details of action plan to fill the existing vacancies?

(b) & (c): Does not arise.

(d) to (f): A proposal for direct recruitment of 24 Barrack and Stores Officers was initiated in 2013. Observations made by UPSC in 2016 thereon have since been addressed. In the meantime, cadre review of Barrack and Stores Cadre which had been undertaken, was completed on 15th December, 2017, following which a number of posts have been upgraded and some have been abolished. These will require amendment of the recruitment rules before filling up of vacant posts.

Will the Minister of DEFENCE be pleased to state:

(a) whether it is a fact that 1573 posts of Barrack and Store (B&S) Cadre of Military Engineer Services (MES) were revived through Ministry of Finance during September, 2016;
(b) if so, the details of vacancies filled-up till date;
(c) if not, reasons for delay of 18 months in filling up of vacancies;
(d) the date by which all revived posts will be filled-up alongwith details of recruitment / DPCs conducted during last three years at each level; and
(e) the details of DPC conducted during last three years in respect of all cadres of MES at each level with present position of each case?

(a) Yes, Sir.
(b) to (d): Post Cadre Review of the Barrack and Store Cadre, which was completed on 15th December, 2017 a number of posts have been upgraded and some have been abolished. These will require amendment of the recruitment rules before filling up of posts.
(e) A total of 44 Departmental Promotion Committees have been conducted for various cadres of Group ‘A’ and Group ‘B’ Officers of MES in the past three years.

The Union Minister of State (Independent Charge) of the Ministry of Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy & Space, Dr Jitendra Singh said here today that the Government led by Prime Minister Shri Narendra Modi is sensitive to employees’ concerns and a number of decisions taken during the last four years, are aimed in the direction of addressing employees’ issues and providing them a motivating environment.

Dr Jitendra Singh was speaking to a delegation of Bharatiya Mazdoor Sangh (BMS) led by Shri M. Sudhakar Rao, Secretary General of Geological Survey of India Employees Sangh affiliated to BMS.

The members of the delegation submitted two memoranda to the Minister. One of them related to the alleged discrepancy in Recruitment Rules (RRs) of the Non-Gazetted Group ‘B’ Assistants in the Ministry of Mines, Geological Survey of India. The other memorandum proposed the setting up of a Joint Consultative machinery for arbitration.

Dr Jitendra Singh held a detailed discussion on each of the issues raised. He said that he will get the issues examined.

The Government of Tamil Nadu, Finace Department issued orders to enhanced rate of Dearness Allowance payable to its employees from the existing rate of 5% to 7% with effect from 1st January 2018.

The arrears of Dearness Allowance for the months of January, February and March 2018 shall be drawn and disbursed immediately by existing cashless mode of Electronic Clearance System (ECS).

Pensioners and Family Pensioners: Dearness Relief enhanced from 5% to 7% applicable with effect from 1.1.2018 to all Pensioners and Family Pensioners.

Rate of Dearness Allowance applicable with effect from 1-1-2018 in respect of employees continuing to draw their pay in the Pre-2006 pay scales and Pre-2016 pay scale/Grade Pay.

Subject: Reiteration of instructions relating to application of own merit in Direct Recruitment for appointment of Other Backward Classes (OBCs)- regarding

The undersigned is directed to say that the Hon’ble Supreme Court in its judgment in the case of R.K.Sabharwal vs. State of Punjab, had, inter-alia, observed that “the reserve category candidates can compete for the non-reserve posts and in the event of their appointment to the said posts their number cannot be added and taken into consideration for working out the percentage of reservation.”

2. As per instructions issued vide this Department’s OM No. 36012/2/96-Estt.(Res) dated 02.07.1997, in direct recruitments to Central Government jobs and services, the reserve category candidates who are selected on the same standard as applied to general candidates will not be adjusted against reserved vacancies. As per instructions issued vide DOP&T OM No. 36011/1/98-Estt.(Res) dated 01.07.1998, only when a relaxed standard is applied in selecting a reserved candidate, for example in the age limit, experience, qualification, permitted number of chances in written examination, etc., such candidates will be counted against reserved vacancies.

3. It has been brought to the notice of this Department by the Hon’ble Parliamentary Committee on Welfare of OBCs that these instructions are not being followed in some cases in direct recruitments to Central Government jobs and services. It is, therefore, reiterated that while making Direct Recruitments, guidelines issued vide this Department’s OM No.36012/2/96-Estt.(Res) dated 02.07.1997 and OM No.36011/1/98-Estt.(Res) dated 01.07.1998 may be kept in view by all concerned.

4. All Ministries/ Departments are requested to bring the contents of this O.M. to the notice of all concerned for information and compliance.

Standard Operating Procedure for REVISION OF PENSION [PRE-2016]
DEFENCE CIVILIAN PENSIONERS AS PER 7th CPC

1. Introduction:
Government of India, Ministry of Personnel, Public Grievances and Pensions, Department of P&PW issued orders vide their OM No. 38/37/2016-P&PW (A) dated 12.05.2017 for revision of Pre-2016 Defence Civilian pensioners as per 7th CPC. These orders were circulated by this office vide Circular number C164 dated 30-05-2017. Pension / family pension in respect of all Defence Civilian pensioners / family pensioners who retired / died prior to 01.01.2016, has to be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale / pay band and grade pay at which they retired / died.

1.1. The estimated number of Defence Civilian pensioners is about 5.5 Lakh. Revising pension, issuance and dispatch of PPO at this scale with the existing manpower was a mammoth exercise in itself. If methods adopted in past were to be deployed, the task would have taken more than 3 years. Dispatch of PPO to Head of Offices was a matter of great concern during similar exercises in past since there were a large number of complaints regarding non-receipt of PPOs sent by this office.

1.2. As per the government orders, the methodology of fixation of pension w.e.f.
1.1.2016 is as under:- The fixation of pension will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. While fixing pay on notional basis, the pay fixation formulae approved by the government and other relevant instructions on the subject in force at the relevant time are to be strictly followed. 50% of the notional pay as on 01.01.2016 will be the revised pension and 30% of this notional pay will be the revised family pension w.e.f. 1.1.2016. In case of family pensioners who were entitled to family pension at enhanced rate, the revised family pension shall be 50% of the notional pay as on 01.01.2016 and shall be payable till the period up to which family pension at enhanced rate is admissible as per existing Rules. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

1.3 The higher of the two formulations i.e. the pension/family pension already revised in accordance with OM No. 38/37/2016-P&PW (A) (ii) dated 04.08.2016 i.e., multiplication by a factor of 2.57 or the revised pension/family pension as worked out in accordance with Para above, shall be granted to pre-2016 Defence Civilian pensioners as revised pension/family pension with effect from 01.01.2016.

1.4 These orders would not be applicable for the purpose of revision of pension of those pensioners who were drawing Compulsory Retirement Pension under Rule 40 of the CCS (Pension) Rules, 1972 or Compassionate Allowance under Rule 41 of the CCS (Pension) Rules, 1972. The pensioners in these categories would continue to be entitled to revised pension in accordance with the instructions contained in GOI, DP&PWO.M. No. OM No. 38/37/2016-P&PW (A) (ii) dated 4.8.2016.

1.5 The pension of the pensioners who are drawing monthly pension from the Government on permanent absorption in Public Sector Undertakings / Autonomous Bodies will also be revised in accordance with these orders. For revision of pension of those pensioners who had earlier drawn one time lump sum terminal benefits on absorption in public sector undertakings etc. and are drawing one-third restored pension will be regulated in terms of P&PW OM No. 4/34/2002-P&PW (D) Vol. II dated 23.06.2017, circulated vide this office circular no. C-173 dated 11-08-2017.

The Defence Accounts Department is entrusted with the responsibility of maintaining the pay accounts of million plus Jawans and JCOs of Indian Army. The Pay Accounts Offices (PAOs) of this department are at the forefront of the concerted efforts that are being put in to ensure that these men get their correct dues within reasonable time frame.

An important requirement to meet the expectations of the end user and ensuring their contentment is that the JCOs/ORs understands their dues and their entitlement. If they further appreciate the processes involved in acceptance or denial of any dues, it would equip them with enough knowledge to have better awareness to contest entitlement inconsistencies, if any.

This handbook was conceptualized with the aim to provide more grasp on the rules of entitlement as well as to have complete transparency of procedures in the PAOs. This first edition contains all the procedures right from the inception stage of publishing and processing of the daily Part II orders, till the final processing and disbursement of entitlements.

The book also details the functional boundaries and constraints of PAOs. The chapters are so ordered that they lay down entitlement parameters in a user-friendly manner. Each of the chapter seeks to enlighten the JCOs/OR on the documentary and procedural requirements for processing an entitlement.

The audit and procedural requirements behind processing of Contingent Bill items, AFPP Fund claims, MACPs, transfer/deputation, leave/TD etc., are all detailed in distinct chapters of the handbook. The deductions from pay and allowances, bank account details, etc. are also elaborated in the book.

In a unique separate chapter interpretation of the Monthly Pay Slip has been elaborated. It details item-wise description of notifications provided in the Pay Slip, which, it is expected, would not only ameliorate grievances of Jawans at the inception stage but also give him confidence regarding legitimacy of the entitlements so granted. A chapter on general FAQs is also included for assistance and ready reference.

The book has sought to cover all the parameters of pay and allowances of JCOs/ORs, incorporating the 7th CPC entitlements as well, wherever available on the date of publication. This book in pdf format is also available on the website of PAO(OR) AMC & 11 GRRC as well as of PCDA(CC), Lucknow.

Subject: – Clarification regarding demarcation of CGHS covered areas under CGHS Wellness Centre.

With reference to the above subject the undersigned is directed to state that in some of the CGHS Cities the areas covered under CGHS were not specified resulting in inconvenience to the beneficiaries. The matter has been reviewed and it is now decided that hereinafter the Coverage of CGHS shall be limited to the areas within 5 km (approx.) radius of the CGHS Wellness Centres. in all CGHS covered Cities. where such demarcations were not specified. The Additional Director, CGHS concerned City shall notify such areas covered under CGHS Wellness Centres.

The serving Central government employees residing outside the CGHS covered areas shall be covered under CS(MA) Rules. However. in all CGHS covered cities the serving Central government employees residing within the Municipal Limits Of the city, shall be given a onetime choice to opt for CGHS (instead of CS(MA) Rules) from the nearest CGHS Wellness Centre.

Subject :- Revision of Pay of Scientists of ICAR in light of scheme of revision of pay of teachers in Universities notified by MHRD vide notification dated 02.11.2017 following revision of pay scales of Central Government employees on recommendations of VIIth CPC.

Sir,

I am directed to state that Indian Council of Agricultural Research (lCAR) has decided to revise the pay scales of Scientists in light of scheme of revision of pay of teachers in Universities notified by MHRD vide notification No.1-7/2015-U.II(l) dated 02.11.2017 following revision of pay scales of Central Government employees on the recommendations of the VIIth CPC. as accepted by the Govemment of India. The revised pay scales and other provisions are as under:

2. Revision of Pay Scales:

2.1 The revised pay scales shall be exactly similar to the revised pay scales given as per the M/o HRD letter dated 02.11.2017 strictly in accordance with the equation between the existing pay scales in case of ICAR Scientists and the pay scales applicable to teachers under the UGC framework immediately before 01.01.2016. and no deviation is allowed.

2.2 For fixation of pay of Scientists in the Pay Matrix as on 01.01.2016. the existing pay (Pay in the Pay Band plus RGP) in the pre-revised structure as on 31.12.2015 shall be multiplied by a factor of 2.57. The figure so arrived at is to be located in the Research Level corresponding to the Scientists” Pay Band and RGP in the new Pay Matrix (Annexure – I). If a Cell identical with the figure so arrived at is available in the appropriate Research Level. that Cell shall be the Revised Pay: otherwise the next higher Cell in that Research Level shall be the Revised Pay of the Scientist. If the figure arrived at in this manner is less than the first Cell in that Research Level. then the Pay shall be fixed at the first Cell of that Research Level.

If a situation arises whenever more than two stages are bunched together. one additional increment equal to 3% may be given for every two stages bunched. and pay fixed in the subsequent Cell in the Pay Matrix.

3. Implementation Date: The date of implementation of the above revised pay shall be 1st January 2016.
4. Incentives for higher qualifications: The incentive structure is built-in in the pay structure itself wherein those having M.Phil or PhD. degree or other higher qualifications will progress faster under CAS. Therefore. there shall be no incentives in the form of advance increments for obtaining the degrees of M.Phil or PhD or other higher qualifications.
5. Date of Increment:
5.1 The annual increments to each scientist would move up in the same Research Level. with a scientist moving from the existing Cell in the Research Level to the immediate next Cell in the same Research Level

5.2 There shall be two dates for grant of increments namely. 1st January and 1st July of every year. instead of existing date of 151 July. provided that a scientist shall be entitled to only one annual increment on either one of these two dates depending on the date of appointment or assessment promotion.

6. Fixation of Pay on Promotion: When an individual gets a promotion. his/her new pay on promotion would be fixed in the Pay Matrix as follows:
On promotion. the scientist would be given a notional increment in his existing Research Level of Pay. by moving him/her to the next higher Cell at that level. The pay shown in this Cell would now be located in the new Research Level corresponding to the post to which he/she has been promoted. If a Cell identical with that pay is available in the new level, that Cell shall be the new pay; otherwise the next higher Cell in that level shall be the new pay of the scientist. If the pay arrived at in this manner is less than the first Cell in the new level. then the pay shall be fixed at the first Cell of that level.

7. Allowances for Scientists in ICAR: As per Deptt. of Expenditure. Ministry of Finance ID Note No. 1(6)/E.III B/2017 dated 20.03.2018, revision of allowances including NPA shall not be made at present. and the same would be taken up for consideration only after allowances are revised by M/o HRD in case of teachers of U niversities/C olleges under UGC framework. Therefore, all allowances will continue to be paid at the existing pay structure. as if. the pay had not been revised with effect from 01.01.2016.

8. Age of Superannuation: The existing age of superannuation of ICAR scientist is 62 years and the same will continue.

9. 30% of the additional financial impact would be met by ICAR from its own resources.

10. An undertaking shall be taken from every employee to the effect that any excess payment made on account of incorrect fixation of pay in the revised Research Pay Level or grant of inappropriate Research Pay Level and Pay Cells or any other excess payment made shall be adjusted against the future payments due or otherwise to the beneficiary.

11. Appropriate action may be taken to revise the pay of the Scientists at the Institutes as per the terms and conditions laid down herein and in accordance with the instructions issued by Government of India from time to time and in consultation with the concerned Internal Finance Division/Unit.

This issues with the approval of Competent Authority after concurrence of Deptt. of Expenditure. Ministry of Finance vide ID Note No. l(6)/E.III B/2017 dated 20.03.2018.
